农村经济变革下宅基地资格权的法律构造

摘要
宅基地资格权的设置是我国农村经济变革过程中的一环,应符合我国农村经济未来发展的基本方向,即在时间上实现农业现代化和传统农业保留,在空间上与城市经济相融合.基于此,宅基地资格权应以保障国家粮食安全、保障农民基本生活权益和提高农民收入为价值目标,从而具有私权利、集体权利和公权力三重属性.而其中的宅基地利益请求权是资格权私权利、公权力以及第三权的权源,并在行权后形成程序性的资格权和实体性的第三权.在此逻辑下,未来法律应首先对当下农民进行身份分类并赋予其不同宅基地资格权权能,之后按照宅基地资格权取得、行权的这一流程设定对应的法律制度.
Abstract
The setting of the qualifications of the homestead is a part of the process of our country's rural economic reform,and should be in line with the basic direction of the future development of our rural economy,which is to realize the modernization of agriculture and traditional agricultural retention in time,and integration with the urban economy in space.Based on this,the right of homestead qualification should take the protection of national food security,the guarantee of farmers'basic living rights and the improvement of farmers'income as its value goal,so as to have three attributes of private right,collective right and public power.The right to claim for homestead interests is the source of qualification right,private right,public power and third right,and forms procedural qualification right and substantive third right after exercising right.Under this logic,it is necessary in the future law to classify the identities of current farmers and give them different rights and abilities of homestead qualification,and after that,to set the corresponding legal system according to the process of acquiring and exercising the right of homestead qualification.
