A Study on the Legal Regulation of Standard-Essential Patents Under the WTO Framework
Standard-essential patent(SEP)disputes have occurred frequently in recent years,drawing the attention of the international community to their legal regulation.This paper analyzes the roles and shortcomings of the TRIPS Agreement and the TBT Agreement in the governance of SEP from the perspective of the WTO framework.It also proposes suggestions for further improving international rules,including the addition of SEP provisions,the introduction of the FRAND principle,and the enhancement of operational regulations for compulsory licensing,aimed at promoting technology sharing and fair competition.
