国家公园旅游不文明行为的治理逻辑与法治因应

摘要
建设以国家公园为主体的自然保护地体系,是当今时代我国生态文明建设的重点任务.文中在梳理国家公园旅游不文明行为的类型及危害后果的基础上,归纳我国国家公园旅游不文明行为的治理动力、理念及工具,并提出解决问题的具体策略.为解决该问题,一方面要强化对旅游不文明行为的道德引导,加强游客行为准则教育;另一方面要优化规则之治,完善游客管理制度,在司法审判中注重社区居民与游客的利益平衡,因时因地制宜,满足公众日益增长的精神文化需求,促进国家公园高质量发展.
Abstract
Building the protected natural area system with national parks as the priority is a key mission that should be implemented to achieve the ecological civilization development in the new era.The paper classifies the types of uncivilized behaviors of tourists in national park and their harmful consequences,summarizes the motivation,concepts and tools of governing uncivilized behaviors in national park tourism in China,and proposes specific strategies to solve the problems.To achieve this,it is necessary to strengthen the moral guidance against the uncivilized tourism behavior and the education on tourist behavior norms on the one hand.On the other hand,it is imperative to optimize the governance of rules,improve the tourist management system,and pay attention to the balance of interests between the local community and tourists injudicial trials so as to meet the growing spiritual and cultural needs of the people and achieve high-quality development of national parks in line with local conditions.
