新业态就业人员劳动保障权益维护策略

企业依托互联网平台进行生产经营,新业态经营模式应运而生。新业态经济丰富就业方式并进一步推动劳动者就业的同时,催生了关于劳动保障权益的思考,新业态就业人员与平台企业劳动关系如何明确、新业态就业人员工作时间界定、新业态就业人员社会保障、新业态就业人员劳动纠纷维权等问题还一定程度存在。分析新业态就业人员劳动保障权益维护面临的挑战,提出新业态就业人员劳动保障权益维护建议:进一步完善相关法律法规及政策规定,构建多元主体协同推进的保障模式,探索多种渠道的纠纷维权路径,以构建和谐劳动关系,规范平台经济发展,缓解劳资矛盾,维护社会稳定。
Protection of labor security rights and interests of new forms of employment practitioners
New forms of business come into being,as more enterprises rely on the Internet for busi-ness and operation,which,in turn,gives rise to new form of economy that promotes the new form of em-ployees.This paper discusses the rights and interests of the labor security,concerning their relationships,working hours,social insurance,and protection of rights among new forms of employment practitioners.Besides,the writer argues for legal protection in addition to countermeasures to ensure the security of rights and interests of the new forms of employees.The purpose is to build a harmonious relationship,standardize the platform,alleviate labor-capital conflicts and maintain social stability.
