At present,the number of cases involving the cross between criminal and civilian in ju-dicial practice has increased sharply,and the causes of the cases are diverse.The theoretical re-search on this issue focuses more on the analysis of the treatment mode,the identification of the facts of the same case,and so on.Coupled with the lag of legislation,the judicial practice has dif-ferent results in the treatment of such cases,and some even weaken the protection of the property rights and personal safety of the perpetrator.This paper discusses the identification of two cases of design contract fraud and civil fraud,as well as the purpose of crime,in order to provide ideas for accurately grasping the boundary of criminal and civil cross cases,identifying crimes and correctly applying penalties.
