The Psychological Mechanism and Legal Regulation of Consumer Facial Recognition in the Era of Digital Human Rights
In digital society,the connotation of human rights has been digitally reconstructed,and the concept of"digital human rights"has been put forward.Digital human rights have the value attributes of security,dignity and fairness,whose connotation mainly includes the right to Internet access,online privacy,data rights to be forgotten and data property rights.In commercial scenarios,the ap-plication of facial recognition technology may bring risks of privacy,security,property and fairness,and there are problems such as sus-pended informed consent,and imperfect legal and administrative regulations.In order to effectively protect consumers'digital human rights,this paper discusses the psychological mechanism of facial recognition by combining self-perception theory,technology acceptance model,social exchange theory and two-factor theory.Finally this paper proposes legal regulation methods of consumer facial recognition from the aspects of informed consent protection,three-principle review,self-restraint,administrative regulation and judicial relief.
