摘要
社会主义核心价值观是中国特色社会主义法治的价值内核.社会主义核心价值观融入刑事司法裁判具有理论、法律和现实需要.当前社会主义核心价值观融入刑事司法裁判还存在对象概括、形式表面、说理不足、缺乏实效等诸多问题.对此,应当明确融入范围、优化融入方式、增强融入说理、提升融入效果,确保社会主义核心价值观有序、有效、有机的融入刑事司法裁判,体现社会主义核心价值体系的丰富内涵和实践要求.
Abstract
The core values of Chinese socialism are the soul of the law-based governance with Chinese characteristics.The integra-tion of socialist core values into criminal judicial judgment has theoretical,legal and practical needs.At present,the integration has many problems,such as the generalization of the object,the superficiality of the form,the lack of reasoning,and the lack of effectiveness.As for these issues,we should clarify the scope of integration,optimize the way of integration,enhance the reasoning,and improve the effect of integration,so as to ensure the socialist core values are orderly,effective and organically integrated into the criminal judicial judgment,realizing judicial fairness and justice.
