摘要
推动能源高质量发展,保障能源安全,需要在安全监管工作上久久为功.随着中国石油天然气的储运量日益增加,油气管道行业的规模日益扩大,管道安全监管问题也日渐突出,现阶段完善中国油气管道安全监管法律制度是保障油气管道安全的必要之举.美国和加拿大的油气管道安全监管法律制度较为成熟,在对其进行考察分析后,结合实际情况提出完善中国油气管道安全监管法律制度的建议.建议增设油气管道安全监管专章,推动《石油天然气管道保护法》更名,设立专门的油气管道安全监管部门并明确该部门分工,推动完整性管理纳入《石油天然气管道保护法》,提升完整性管理标准水平,规范应急预案制度,健全应急信息化制度,以此来建立符合中国国情的油气管道安全监管制度,推动能源高质量发展.
Abstract
Safety supervision is of vital importance in promoting high-quality energy development and guaranteeing energy security.A-long with the increasing storage and transportation volume of oil and gas in China,the scale of the oil and gas pipeline industry is ever expanding and subsequently the oil and gas pipeline safety supervision has become prominent.Currently there exists the necessity of perfecting China's legal system of oil and gas pipeline safety supervision.As the United States and Canada have developed relatively mature systems,which may shed light to our system.This paper,based on the investigation and analysis of the legal system in the two countries,puts forward suggestions in combination with China's actual situation.The suggestions are listed as follows:renaming The Oil and Gas Pipeline Protection Law and adding a chapter on pipeline safety supervision,establishing a specialized department and clarifying its responsibilities,promoting integrity management into the Law,enhancing integrity management levels,standardizing the emergency plan system and optimizing the informatized system.All the above-mentioned measures are intended for bettering the oil and gas pipeline safety supervision system in line with China's conditions.
