The Logic of Exemption and Duty of Care from Copyright Infringement on UGC Platform:Also on the Case of "Tencent v. Douyin for Infringement of the Copyright of Yunnan Worm Valley"
The deep integration of digital economy and real economy has become the proposition of the Times.UGC digital platform re-presented by social platforms and short video platforms has become the backbone of structural reform.The goal of the top 20 is to build an internationally competitive digital industrial cluster.However,considering the internationalization of intellectual property rights,the current domestic copyright protection environment is still in urgent need of strengthening.The specific performance is in the frequent in-fringement of users,the platform's duty of care is unclear,the principle of liability and the boundary of immunity is unclear.The im-portance of duty of care in proving platform responsibility and active copyright protection can be further clarified from the two aspects of internal determination and external performance of duty of care,and then the legalization of duty of care and the specific logic of plat-form exemption can be clarified from three dimensions:the clarification of pre-filtering obligation,the design of in-process monitoring obligation and the degree of post-governance obligation.
