技术调查官制度的内在逻辑与整体建构

摘要
技术调查官制度源于德国、日本、韩国等国的制度实践,这一制度为中国知识产权领域所吸纳,近年来在生态环境审判领域亦有设立之趋势.技术调查官制度有其特有的内在逻辑,即为法官提供技术辅助,以克服法官在审判中面对日益繁杂的技术问题难以形成心证的困境.这一特有的制度逻辑,填补了中国技术事实查明方式的不足.但目前对技术调查官制度适用领域的限制,使这一制度的价值无法全面展现;立法中对技术调查官制度功能的不明晰,亦导致了技术调查官制度设计上存在问题.对此,可去除适用领域的限制,设立整体性的技术调查官制度,并基于其内在逻辑理顺制度架构.
Abstract
The technical investigator system originated from the institutional practices of Germany,Japan,South Korea and other coun-tries.This system has been absorbed by China's intellectual property field and there is also a trend of setting up in the field of ecologi-cal environmental justice in recent years.The technical investigator system has its own unique internal logic,providing judges technical assistance to overcome the difficulty of forming mental evidence in the face of increasingly complex technical problems in trials.This u-nique institutional logic plug loophole of China's technical fact-finding methods.However,the current restrictions on the applicable fields of the technical investigator system prevent the value of this system from being fully demonstrated.The unclear function of the technical investigator system in the legislation also leads to problems in the design of the technical investigator system.In this regard,the restrictions on applicable fields can be removed,a comprehensive technical investigator system can be established,and the institu-tional structure can be rationalized based on its inherent logic.
