Deconstruction of Environmental Rights in Hofield's Theory of Legal Relations
As an important application tool of analytical jurisprudence,Hofield's theory of legal relations fits the ambiguous and contro-versial dilemma of environmental rights in terms of attributes,subjects,scopes of power,implementation and prospects with its rigor-ously critical nature.It is of great likelihood to formulate a complete logical system of existing environmental rights and draw analytical conclusions from forward-looking issues such as the overall existence and overall implementation,based on the existing exploratory stud-ies and aided by analyzing the following implementation problems.The existing acquired results include rights of ideal environment to live,ideal environment to enjoy,exclusion of environmental harm,exclusion of environmental damages,sustainable usage of re-sources,obtaining environment information,participation in environmental maintenance and management,obligation to protect environ-mental quality and assumed liability for damages;whereas the implementation problems may cover as biological interests,environmental space benefits and relief of environmental rights.
