Authority Regulation of Corporate Vocational Training in Context of Lifelong Vocational Skills Training
The problems of the unclear management authority of vocational training in Chinese enterprises,alienation of enterprises in practice,and abuse of management power to infringe on the legitimate rights and interests of employees were expounded.The legal sources of enterprise management authority were analyzed.According to the content of enterprise training,the management authority in different training behaviors was differently defined.It was proposed that the exercise of management rights should be based on laws and regulations,follow the principles of legality of procedures,legality and reasonableness of content,and shall not infringe on the basic rights of employees,and the specific content of labor contracts,collective contracts or vocational training agreements shall be exercised to the limit;enterprises should take the initiative to inform employees of the specific content of vocational training and sign contracts with them;the labor and social security supervision department has the right and shall take the initiative to review in advance whether the form,time,venue,and curriculum of vocational training of enterprises are infringing,and take the initiative to perform duties such as in-process inspection and ex-post punishment.
