Copyright Protection of Content Created by Virtual Digital Humans in the Metaverse:A Perspective Based on Comparison with Artificial Intelligence Generated Content
The metaverse takes artificial intelligence as its technical base,and virtual digital human is a product of the development of artificial intelligence to a certain stage.The content created by virtual digital human and the content generated by artificial intelligence are homogeneous in terms of creation subject,generation process and bearing medium,etc.The degree of commonality between the two can provide a prior theory and reference for the copyright protection path of the former.Specifically,virtual digital human-created content should be protected by copyright instead of entering the public domain or bearing the name of neighboring rights;in terms of the determination of the generated content,the au-thor-centered originality standard should be adhered to,and the new work experience should be used as the basis for the determination,meeting the dual conditions of emotional input and objective expression;in terms of legal application,Article 3 of the current Copyright Law should be taken as the benchmark,and the virtual digital content should be subsumed into the existing statutory work types or covered by underwriting provisions through legal interpretation;in terms of the attribution of rights,according to the principle of reciprocity of rights and obligations,it is appropriate to attribute the copyright rights related to the virtual digital content to the natural person subjects.
