The Rule Construction of Structural Separation of Data Property Rights:Theory and Practice
"The Opinion on Building a Data Base System to Better Utilize the Role of Data Ele-ments"proposes a system of structural separation of data property rights and establishes a mechanism for the operation of property rights under the"separation of three rights".However,the rules and practical pathways for structural separation still require specific clarification.In theory,the scope and type of ob-ject of data property rights should be clarified on the basis of the theory of value differentiation,and the module of rights should be rooted in the theory of property rights in combination with the revelation of the system of"separation of three rights"of land.In practice,starting logically with the operational principles and legal boundaries of"separation of three rights",it constructs rules for data rights confir-mation,registration and trading models,offering a legal implementation pathway for structurally separa-ting data property rights.The study aims to provide legal support for the prosperity of the digital econo-my and ensure effective protection for data property transactions.
