On the Setting of Lawsuit Order in Civil Public Interest Litigation for Personal Information Protection
Article 70 of The Personal Information Protection Law of China includes personal infor-mation in the objective protection scope of public interest litigation,and defines the eligible plaintiffs for this litigation,but does not specify the order of prosecution among the eligible plaintiffs.To cope with the resulting risks,such as difficulty in starting litigation procedures,improper allocation of litigation re-sources and violation of the inherent coordination of the legal system,the plaintiff's lawsuit order of civil public interest litigation on personal information protection should be clearly defined as"consumer organizations stipulated by law/organizations determined by the national network information department-procuratorial organs"to improve the effectiveness of this remedy path.
