The joint issuance of documents by the party and government operates under the"dual spiral"structure of the"party"and"government".It is an institutional form with dual attributes of party rules and national laws,embodying the political background of the socialist party with Chinese character-istics in practice.Due to its realistic orientation,it developed with insufficient legislative support and dis-putes over its rationality and legitimacy and even grew abnormally in some areas.In order to address such problems,the nature of the joint issuance of documents by the party and government needs to be discussed,its actual normative force should be emphasized,and the connection between party rules and national laws behind them should be clarified.From the dimensions of intra-party governance and nation-al governance,the joint issuance of the documents by the party and government can be used as the micro entry point to straighten out the coordination and cooperation relationship between party rules and national laws in the"party and government unification"pattern.On the one hand,a higher-dimensional theoretical basis can be provided for the supervision and review of joint issuance of documents.On the other hand,a more specific and operable realistic path can be paved for optimizing ways of exercising party leadership and advancing the rule of law in China.
