Judgment Method of Administrative Agreement Performance Litigation
In current judicial practice,disputes over the performance of administrative agreements are generally characterized by inconsistent judgments for identical cases,high overall rejection,and ap-peal rates,which uncover a poor state of relief,including adjudications not in accordance with the ap-peal and meaningless judgments of winning a lawsuit.The reasons may be related to various factors,such as ambiguities in relevant legislative norms,limitations on the power of judicial subjects,and high financial pressure due to poor economic conditions.Therefore,the plaintiff's reasonable claims should primarily be addressed through the substantive performance of the judgment to the greatest extent.Under other circumstances,the claim-dismissed judgment should be adopted legitimately,remedy and compen-satory judgments should be adopted in a timely manner,and single or combined compensatory judgments should be supplemented to fully utilize the important role of justice in resolving administrative disputes and relieving the rights of the parties involved.
