The Dilemma and Response to the Recognition of Labor Relations Under Platform Algorithm Control
With the rapid development of platform economy and algorithm technology,the role of online platforms has undergone a transformation from employers to service intermediaries,and through data possession and algorithm processing and utilization,it has essentially achieved implicit management and control of workers,thereby avoiding employment responsibilities.In the face of the dif-ficulties in identifying employment entities and the failure of criteria for attribute identification,we can draw on the expanded applica-tion of the US Veil Piercing Theory in the field of labor law,based on the system of denying corporate personality,to construct a rec-ognition path with data possession control as the core element,and conduct economic tests in individual cases to effectively identify employment entities and protect labors'rights and interests.
