The Attributes,Types and Protection of the Data Rights of Universities in the Age of Big Data
In the age of big data,the topic of data rights has been at the forefront of current academic debate.The data sovereignty of the state and the data privacy of natural persons are sacred and inviolable,and the data property rights of the enterprises are also included in the scope of protection in judicial practice,but the data rights of universities have not attracted enough attention.We need to make a theoretical analysis of the attributes and types of university data right,and then put forward the legislative protection path.From the perspective of attributes,the data rights of universities has both public rights and private rights and shows special attributes different from other forms of data rights.In terms of types,the data rights of universities are divided into collective data rights and individual data rights in the subject,original data rights and derived data rights in the object,and result data rights,record data rights and natural data rights in the content.Based on these,it is a feasible path to formulate the Higher Education Data Law of the People's Republic of China or add a special chapter on data rights to the Higher Education Law of the People's Republic of China for the legislation of the data rights of universities,where the legislative principles of"Data rights determined by law","one data loaded with multiple rights",and"one data come from one source"are established to protect the different attributes and different types of university data rights respectively.
