摘要
数字法院建设要求司法数据与社会治理进行有效联接,快速反映社会矛盾焦点,使社会治理相关主体从模糊管理转向精准治理,为善治目标的实现提供现实路径.通过对几类常见民事纠纷的类型化分析,针对问题治理及问题预防等社会治理的薄弱环节,发现法院与社会治理相关主体存在数据传递不畅通、数据收集不规范的问题.而缺乏类型化司法数据推送、缺乏共享数据协同治理平台、数据联接治理内驱力不足是产生前述问题的原因.应从数据源、数据平台、数据管理三个方面落实司法数据与社会治理的有效联接,通过建立可靠数据源、完善司法数据模型,融合法院内外现有数据平台,健全动态数据管理、完善数据推送机制,打造智慧治理共同体.
Abstract
The construction of Digital Courts requires an effective connection between judicial data and social governance and a quick reflection of the main civil disputes to enable the relative subjects of social governance to transform from extensive management to precise governance and provide a practical path to realize good governance.Through a categorized analysis on several types of common civil disputes,particularly on such weak points in social governance as preven-tion and resolution of disputes,the issues of unsmooth data transmission and unstandardized data collection between courts and the concerned subjects of social governance are detected.The rea-sons for the aforementioned issues include the lack of categorized judicial data push,a coordinated governance platform based on data sharing,and sufficient drives for data connection and govern-ance.To realize the effective connection between judicial data and social governance,we should work on three aspects:data source,data platform,and data management.Specifically,this arti-cle suggests that we should establish reliable data sources,improve judicial data models,integrate the existing data platforms of courts and other institutions,and promote dynamic data management and transmission mechanisms,to build a community of intelligent governance.
