数据主体权益保护制度的构建:现实基础、规则范式与规范原则

数据要素过程是数据主体集体协作参与数据价值实现的整体流程,集体协作的行为模式直接决定了数据主体权益保护参照的规则范式与规范设计的基本原则.数据要素过程具有产业化和市场化的基本趋势,围绕数据来源者与数据处理者形成优先性与集体性的主体结构特征.数据主体的权益保护基于提高效率与保障稳定的价值导向,应建立逻辑统一、契合需求与呼应政策的数据主体权益保护制度.同时,借鉴集体协作特征的著作权规则范式,协调和规范数据主体之间的行为模式,根据数据主体对应的贡献合理分配数据要素过程的预期收益.一方面,坚持优先保护特定数据主体的规范原则以提高效率;另一方面,坚持构建共识的规范原则以保障数据价值实现过程的稳定性.
Abstract
The data elements process is the overall process of data subjects'collective collab-oration and participation in the realization of data value,which directly determines the basic prin-ciples of rule paradigm and regulatory design concerning the protection of data subjects'rights and interests.A general trend of industrialization and marketization of data elements process could be found and a structure featuring priority and collectivity between data sources and data processors has been formed.The protection of data subjects'rights and interests should be based on the val-ues of efficiency and certainty and the system should be designed to meet the requirements of keeping logical coherence,meeting the needs of data subjects,and echoing the governmental poli-cy.We should reference on the rule paradigm of copyrights collective collaboration to coordinate and regulate the behaviors of different data subjects and to allocate the expected revenue according to their contributions in the data elements process.On the one hand,to enhance efficiency,we should insist on the principle of prioritizing the protection of certain data subjects;on the other hand,we should insist on the principle of building consensus to guarantee the certainty of realiza-tion of data value.
