数字规制的共益定位与模块化构造

摘要
数字规制不仅意味着法律系统对技术系统的规训,同时也伴随着技术逻辑对法律运行的重构.尤其是对于数字风险兼具积极与消极意义的"双面性"风险而言,法律与技术缺乏协调与部门法之间忽视合作都会导致规制过度或规制不足.数字规制的体制设计需要与规制对象相匹配,从共益的语境对现有的规制理念进行整体升级,通过发挥法律与技术的比较优势来共同管控风险,进而构建以技术分配增量实现法律正义与法律分配减量实现技术正义为基座的嵌套型数字规制模式.这种新型规制模式不仅可以为培育具有技术逻辑的法律系统提供制度环境,还可以对现有破碎化的部门法加以模块化构建,有助于协调运用不同部门法的风险控制工具来共同应对日益严峻的数字风险,助推数字规制实现从无序性到功能性的转变.
Abstract
Digital regulation not only implies that the legal system regulates the technological system,but also that the logic of technology reconfigures the operation of the law.Particularly for the"two-sided"nature of digital risk,which has both positive and negative meanings,the lack of coordination between law and technology and the neglect of cooperation between sectoral laws can lead to over-regulation and under-regulation.The design of the regulatory system of digital regulation needs to match the object of regulation,upgrade the existing regulatory concept from the context of co-benefits,and jointly control risks by giving full play to the comparative advantages of law and technology,so as to build a nested digital regulatory model based on the incremental realisation of legal justice by technological distribution and the reduction of technological justice by legal distribution.This new regulatory model can not only provide an institutional environment for the cultivation of a legal system with technological logic,but also modularise the existing fragmented sectoral laws,which can help to coordinate the use of risk control tools of different sectoral laws to jointly deal with the increasingly severe digital risks,and help to promote the transformation of digital regulation from disorder to functionality.
