Influencing Factors of Judgment Result of Infringement Disputes Involving Information Network Dissemination Right in Public Libraries:An Empirical Study Based on 345 Judgment Documents
Digital services play an increasingly important role in the functions of public libraries,but because of the close relationship with information network dissemination right,there are also many disputes.Using 345 judgments,this paper examines the influencing factors of the judgment results of public libraries involved in information network dissemination right disputes.The results show that there is a significant correlation between the library level,two behavior modes of mirror loading and link offering,four judgment bases including pre-review,in-process restriction,post-event remedy,and procurement and use,and the judgment results.Based on the above analysis results,in order to eliminate the contradiction between public libraries and rights holders,public libraries themselves should attach importance to the process of mirror loading and strengthen awareness transformation.The library industry should include legal factors in the evaluation and grading considerations.At the legal level,the fair use system should be valued and modified,and the safe harbor rules should be improved and activated.
