Legal Risks of Library Mirroring Service and Response Scheme
With the rapid development of modern information technology such as the Internet and big data,it is an inevitable trend for libraries to realize the development of digital transformation in resource collection and document service.This paper summarizes and sorts out the legal risks brought by mirroring service to libraries and database providers through judicial decision,and analyzes the problems involved in the legal risks from multiple perspectives such as its causes,nature,and the rationality of judicial judgments.It puts forward the countermeasures of mirroring service legal risks from several aspects:improving relevant legislation,giving full play to the guiding role of the judicial system,strengthening library management,and perfecting authorization of database providers and publishing institutions from the root.It aims to provide guidance for libraries and database providers to effectively avoid the legal risks of mirroring service.
