数字时代劳动关系认定标准的困境与出路——以网约配送员为视角

我国网约配送员劳动关系认定标准不一致导致同案不同判现象,现有认定标准难以对灵活用工的劳动关系进行认定.基于此,应坚持以保护劳动者利益为主,兼顾公平与效率的原则,将构成要件转化为要素考察,增加多元的从属性考量因素,实行双线运行标准兼顾其他因素的综合标准,找到劳动关系认定标准的出路.
The Dilemma and Solution of Labor Relations Standard in the Digital Age:From the Perspective of Online Delivery Personnel
The inconsistent standards for the identification of labor relations of online delivery person-nel in China lead to different judgments in the same case.And the current standards are difficult to identify the labor relations of flexible employment.Based on this,we should adhere to the principle of protecting the interests of workers,taking into account the principles of fairness and efficiency,transforming the con-stituent elements into factor assessment,increasing multiple subordinate factors,and implementing a com-prehensive standard of dual line operation standards which take into account other factors to find a way out of the labor relationship standards.
