论敏感个人信息的界定与民法保护

摘要
我国《个人信息保护法》中个人信息的分类并没有采用《民法典》人格权编中私密信息与非私密信息的模式,而是采用了敏感个人信息这一全新概念,这一立法动向也引发了概念不明确的质疑.在解释何为敏感个人信息时,需分别从内涵和外延两方面具体展开,在对敏感个人信息的基础概念作出界定的同时明晰其判断标准,并通过辨析敏感个人信息与私密信息的关系,探寻保护敏感个人信息的根本路径.
Abstract
The classification of personal information in China's Personal Information Protection Law does not adopt the model of private information and non-private information in the Code of Personality Rights,but adopts the new concept of sensitive personal information.This legislative trend also raises the question of unclear concept.In the interpretation of what is sensitive personal information,it is necessary to expand from the connotation and denotation respectively,and define the basic concept of sensitive per-sonal information while clarifying its judgment criteria.And through discriminating the relationship be-tween sensitive personal information and private information,explore the fundamental path to protect sen-sitive personal information.
