The Logical Mechanism and Optimization Path of Whole-process People's Democracy to Promote Judicial Modernization
General Secretary Xi Jinping's important discourse on"seeing the people to feel the fair-ness and justice in every judicial case"provides a fundamental guideline for the implementation of whole-process people's democracy and deepening reform comprehensively in the judicial field to achieve judicial modernization.On this basis,the third plenary session of the 20th Central Committee of the Com-munist Party of China made an important decision to further focus on the development of the whole-process of people's democracy and promote deepening reform in the judicial field.The concept and system of whole-process of people's democracy have shaped the unique characteristics and advantages of Chinese ju-dicial modernization,and provided value guidance,method guidance and efficiency improvement for judi-cial modernization with its for-the-people feature,completeness and practicality,fully demonstrating the organic unity of system logic and governance logic.In terms of institutional logic,whole-process people's democracy of"all-round","full-chain"and"full-coverage"respectively promotes the value of the judi-cial system from abstract to concrete,the structure from partial to comprehensive,and the function from single effect to multiple effect.In terms of governance logic,the unification of the logic of co-governance in the subject,the logic of the rule of law in the manner,the logic of emotional governance in effect,and the logic of intelligent governance in technology have been realized.Based on the dual logical framework of system and governance,it is necessary to further give full play to the significant advantages of whole-process people's democracy,and improve the practical efficiency of judicial modernization through concept empowerment,system empowerment to improve the institutional guarantee of judicial modernization,and mechanism empowerment to improve the practical efficiency of judicial modernization,so as to provide the-oretical support and practical guidance for whole-process people's democracy to promote judicial moderni-zation.
