An Analysis of Regulatory Approaches to Addressing Market Power Abuse by Online Sales Platforms
With the development of the platform economy,online sales platforms occupy an increasingly important market position.However,due to the excessive concentration of market power,the bargaining position between online sales platforms and operators within the platforms has become increasingly unbalanced,triggering conflicts between the two.Currently,each country or region is actively addressing this legal problem,focusing on the abuse of superior bargaining position.Different countries and regions stipulate this system in different legal systems,mainly manifesting in two modes:antitrust and industry regulation.After analyzing,industry regulation and antitrust are different in terms of models,effects,and goals of law enforcement.China has a highly developed online sales market,and there is nothing inherently wrong with adopting the mode of industry regulation for the unfair trade behaviors committed by online sales platforms against operators within the platform.However,China's existing regulatory approach has certain deficiencies.To achieve effective supervision of online sales platforms,China can optimize its industry regulation path by improve behavioral norms,external review mechanism,industry standards,class action lawsuits and etc.
