Analysis on Anti-Monopoly Governance of"Either-Or Choice"Behavior of Chinese E-Commerce Platforms
At this stage,the vigorous development of the digital economy has made the competition between e-commerce platforms increasingly fierce.Alibaba,Meituan and other Internet giants have been punished by the State Administration for abusing their dominant market position and requiring merchants to have only one choice for their business platforms,which has caused great repercussions in society.This kind of"either-or choice"behavior destroys the order of market competition and hinders the healthy development of economy,so it needs to be regulated by law.However,there are some problems in the treatment of monopoly behavior in our country,such as the obstacle of law application,the lag of traditional supervision mode and the fragmentation of platform supervision.Through the comparative analysis of the relevant legislation and judicial practice in the EU and the United States,this paper puts forward suggestions to improve China's anti-monopoly governance:strengthen the anti-monopoly legislation in the field of e-commerce platforms,promote the integrated development of pre-prevention and post-event supervision,and build a collaborative regulatory system.
