Institutional Response to the Protection of Financial Consumer Information Rights in the Context of Algorithms
Algorithms affects the cognition,judgment,and decision-making processes of financial consumers,which may have adverse effects on the protection of their information rights.Under the background of the current algorithm,the interests protection of financial consumer rights,especially information rights faces new challenges,The financial consumers may be treated unfairly due to algorithmic errors or biases,and the existing legal and regulatory frameworks have not fully addressed these challenges.Although China has established a preliminary legal governance system for the rights of financial consumers'information,there are obvious issues such as inadequate legislative regulation,failure to fully fulfill the responsibility of comprehensive protection,and deviations in supporting systems.It is recommended to construct a legislative system that clarifies the boundaries of rights and responsibilities and establish a sound functional regulatory mechanism from the perspective of regulatory innovation,so as to balance industry development and technological application,prevent and resolve financial risks,enhance financial consumer confidence,and maintain social fairness and justice.
