海南自贸港促进企业日常合规风险防控管理的路径探究

摘要
企业合规本质是为了防范合规风险而建立起来的管理机制,在目前行之有效的两种合规管理模式中,从日常性企业合规管理模式出发,合规风险尚未显化为违规行为,对企业合规风险防控的讨论应当基于此范畴.企业合规风险防控不仅是优化营商环境的手段,也与海南自贸港衔接世界银行新营商环境评估体系促进营商环境优化的未来部署相契合.在日常性企业合规管理模式视角下对海南自贸港促进企业合规风险防控的路径进行探究,一方面,需要利用授权立法完善相关法规,发挥对企业合规风险防控的激励作用,另一方面,需要完善企业合规风险防控相关公共服务.
Abstract
The essence of enterprise compliance is a management mechanism established to prevent compli-ance risks.Among the two effective compliance management modes at present,the compliance risk has not yet become a violation from the daily enterprise compliance management mode,so the discussion on the prevention and control of enterprise compliance risks should be based on this category.Corporate compliance risk pre-vention and control is not only a means to optimize the business environment,but also in line with the future deployment of Hainan Free Trade Port connecting with the World Bank's new business environment assessment system to promote business environment optimization.From the perspective of daily enterprise compliance management mode,it is necessary to explore the path of promoting enterprise compliance risk prevention and control in Hainan Free Trade Port.On the one hand,it is necessary to improve relevant laws and regulations by using authorized legislation to give play to the incentive role of enterprise compliance risk prevention and control,on the other hand,it is necessary to improve public services related to enterprise compliance risk prevention and control.
