摘要
《中华人民共和国民法典》关于成年人监护制度基本沿用《中华人民共和国民法总则》的内容,适逢老龄化的背景和国际公约中对人权的倡导,本文提出成年人自主决定权和维持本人生活正常化的理念.针对成年人监护制度的规定存在过于宽泛,不够系统的问题,本文认为应该及时完善相关问题,适用我国实际情况并实现成年人监护法律制度现代化.
Abstract
The Civil Code's adult guardianship system basically follows the content of the General Provi-sions of the Civil Law,coinciding with the background of aging and the promotion of human rights in interna-tional conventions,and puts forward the concept of adults'right to make independent decisions and maintain the normalization of their own lives.I have learned that the provisions on the adult guardianship system are too broad and not systematic enough,and we should improve the relevant issues in a timely manner,apply the actual situation in our country and realize the modernization of the legal system of adult guardianship.
