涉黑案件财产处置的难点及解决方法探析

摘要
涉黑案件案发量大、涉黑金额高、权属关系复杂,对行为人进行定罪量刑固然重要,能否对涉黑财产进行有效的处置也是治理本罪的核心问题.传统刑事诉讼对涉黑财产处理过程中存在重"对人之诉",轻"对物之诉",刑事定罪与债权保护之间发生冲突.具体可能存在合法财产与"涉黑"财产区分难、被害人及利害关系人合法财产权益保障难、资金流转复杂、缺乏有效的财产处置程序等难点,现行刑事治理方案已不能完全适应涉黑财产处置的需要.为此,应当重视对涉黑案件财产的处置,积极推进并构建更加完备的财产处置机制.
Abstract
With a large number of cases involving criminal activities,high amounts of money involved,and complex ownership relationships,it is important to convict and sentencing the perpetrator.Whether the property involved in criminal activities can be effectively disposed of is also the core issue in governance of this crime.In traditional criminal litigation,there is a conflict between criminal conviction and credi-tor's rights protection,as there is a heavy emphasis on"lawsuits against individuals"and a light emphasis on"lawsuits against property"in the handling of property related to criminal activities.There may be diffi-culties in distinguishing between legitimate property and"black related"property,ensuring the legitimate property rights and interests of victims and stakeholders,complex fund circulation,and the lack of effec-tive property disposal procedures.The current criminal governance plan cannot fully meet the needs of black related property disposal.Therefore,attention should be paid to the disposal of property related to crimi-nal cases,and a more comprehensive property disposal mechanism should be actively promoted and constructed.
