虚拟货币的金融监管困境与出路

摘要
虚拟货币是区块链技术应用的产物,是区块链技术发展的最新成果.由于其去中心化、匿名化等特征,使得虚拟货币在金融监管领域具有法律和监管上的特殊性.虚拟货币的金融监管面临着法律依据不充分、监管主体及职责模糊等问题.我国应当在充分考量虚拟货币自身特性的基础上,从法律和政策两个层面为虚拟货币的金融监管提供支持.在法律层面,应尽快出台专门法律规范虚拟货币金融监管;在政策层面,应加强虚拟货币的金融市场风险管控,建立针对虚拟货币的监管协调机制.
Abstract
Virtual currency is the product of the application of blockchain technology,and the latest achievement of the development of blockchain technology.Due to its decentralization,anonymity and other characteristics,virtual currency has the particularity of law and regulation in the field of financial regu-lation.The financial regulation of virtual currency is faced with problems such as insufficient legal basis,fuzzy regulatory subject and responsibility.On the basis of fully considering the characteristics of vir-tual currency,China should provide support for the financial regulation of virtual currency from the legal and policy levels.On the legal level,special laws should be issued as soon as possible to regulate the finan-cial regulation of virtual currency;on the policy level,the financial market risk control of virtual cur-rency should be strengthened,and a regulatory coordination mechanism for virtual currency should be estab-lished.
