摘要
《农村土地承包法》规定土地经营权可以设立融资担保,但土地承包经营权人自设融资担保的客体存在争议.从规范层面入手,明确土地承包经营权包括土地承包权与土地经营权两项权利,后者可基于包含关系成为融资担保的客体,不违反物权法定原则.土地经营权担保价值通常体现为土地流转价格,在土地承包经营权人自设担保时价值较稳定,但在土地经营权人设立担保时,担保价值取决于其是否支付流转对价,影响土地经营权抵押融资政策的实施效果.土地经营权人可以约定方式将土地上其他财产一并纳入担保财产范围,对融资担保客体进行适当扩张,增强融资担保设立的可行性.
Abstract
Law of the People's Republic of China on Land Contract in Rural Areas stipulates that the financ-ing guarantee can be set up with the land management right.However,there is controversy over the object of the financing guarantee set up by the rural households.Starting from the normative levels,it's clear that the land contracted management rights include both contract rights and operation rights.Basing on the inclu-sive relationship,the latter may become the object of the financing guarantee,without violating numerus clausus principle.The guarantee value of land management right is typically manifested in the land transfer price,which is more stable when the contractor creates security for its own financing.Conversely,the value of a guarantee set by a land management right holder hinges on whether he or she pays the transfer consider-ation,thereby impacting the efficacy of the land management right mortgage financing policy implementa-tion.To enhance the feasibility of establishing financing guarantee,the land management right holder may appropriately expand the object of the financial guarantee by including other property on the land into the scope of the guarantee property in the contractual agreement.
