平台经济产业反垄断问题的复杂性和建议——以阿里巴巴反垄断为例

摘要
作为互联网平台发展到比较高级阶段所形成的一种新型经济形态,平台经济具有一些不同于传统经济的特点.目前我国的平台经济在总体上呈现出垄断与竞争并存的局面,在相关细分领域基本呈现出高度集中的市场结构,网络平台中存在着互联网影响力和跨界性等特征,因此当其涉及垄断行为时就必须应用反垄断理论进行适时的回应和改革.从2020年开始,我国政府逐步加大了对一些行业中资本无序扩张和不公平现象的反垄断监管.本文对平台经营垄断现象进行了调查研究,发现可以通过管理前置来对平台经营活动实施有效控制,防止平台垄断行为的出现,以保障公平的市场秩序,推动平台经营的健康发展,为政府行政管理创新提供必要的理论依据.
Abstract
As a new economic form formed by the development of Internet platform to a more advanced stage,platform economy has some characteristics different from the traditional economy.At present,the platform economy of our country presents the situation that monopoly and competition coexist on the whole,and the mar-ket structure is highly concentrated in the related subdivision fields.The platform economy has the charac-teristics of network effect and cross-border,which are different from the traditional economy.The theory and practice of anti-monopoly need to make timely response and necessary changes,in our country,we should pay attention to the balance between competition and innovation in the field of platform economy,and give de-tailed rules guidance.Since 2020,the government has gradually strengthened the anti-monopoly supervision on the disorderly expansion of capital and unfair competition in some fields.This paper investigates and re-searches the problem of platform economic monopoly,and find that it can effectively supervise the platform economy by means of pre-regulation,so as to avoid the occurrence of platform monopoly behavior,to maintain fair competition in the market order,promote the healthy development of the platform economy,for the gov-ernment to provide a theoretical reference for regulatory innovation.
