The amendment of the Legislation Law in 2023 added the content of the regulation-making power of Hainan Free Trade Port.The constitutionality of the local legislative power has been recognized.As a newly established local legislative power,the standardized exercise of the power can improve the socialist legal system with Chinese characteristics,play the role of a pioneer in the deepening reform of Hainan Free Trade Port,and provide institutional support for the construction of Hainan Free Trade Port.Upon examining the current situation of the exercise of the power,there are still issues such as unclear boundaries of legisla-tive matters,unclear selection order of the"three local legislative powers"in Hainan,and imperfect filing review mechanisms.In order to make full use of the regulation-making power of Hainan Free Trade Port,it is necessary to clarify the exercise boundaries of the power,determine the priority order of the application of Hainan's"three local legislative powers",and improve the filing review mechanism to fully play the role of the powers,ensuring the coordinated development of reform and the rule of law.
