直播购物已成为当今人们必不可少的消费方式之一.随着直播经济的蓬勃发展,许多法律问题也随之出现.当前平台对不同商业模式下的直播销售活动注意义务不清晰,机械适用"通知—必要措施"规则导致了"诉前禁令"的不当效果.为探寻规则适用的正确出路,应当从梳理"通知—必要措施"规则的立法背景出发,比较"通知—必要措施"规则与"诉前禁令"的适用要件,引入实质审查结合形式审查判断通知有效性.直播电商平台不仅是权利人与平台内经营者沟通的信使,更是维护直播销售市场生态环境的重要力量,应当以平台自治为基础探索"通知—必要措施"的具体实施,明确平台义务,增强平台治理能力.
The Dilemma and Way Out of the"Notice-Necessary Measures"Rule of Live Streaming E-Commerce Platform
Live shopping has been regarded as one of the indispensable consumption ways for people today.With the vigorous development of live shopping economy,many legal problems have begun to breed and spread rapidly.At present,the platform's duty of care for live sales activities under different business models is not clear,and the mechanical application of the"notice-necessary measures"rule has led to the improper ef-fect of"pre-lawsuit injunction".In order to explore the correct way out of the application of the rule,we should start from the legislative background of the"notice-necessary measures"rule,compare the applicable requirements of the"notice-necessary measures"rule and the"Preliminary Injunction",and introduce the sub-stantive review combined with the formal review to judge the effectiveness of the notice.The live streaming e-commerce platform is not only a messenger for the communication between the right holder and the operators within the platform,but also an important force for maintaining the ecological environment of the live streaming sales market.It should explore the specific implementation of"notification-necessary mea-sures"on the basis of platform autonomy,clarify platform obligations,and enhance platform governance ca-pabilities.
