个人医疗健康信息合理使用初探

摘要
使用个人医疗健康信息虽然会造成利益冲突,但也能满足防治公共卫生危机、助推智慧医疗企业发展以及发展医学研究的现实需求.又因为合理使用制度本身具有调和利益冲突、促进信息流通的作用,且个人医疗健康信息具有特殊性,所以个人医疗健康信息的合理使用具有一定的正当性.应当通过细化《个人信息保护法》中个人医疗健康信息合理使用制度的规定、严格解释合理使用个人医疗健康信息的情形、用比例原则审查使用的"合理性"来完善个人医疗健康信息合理使用制度.
Abstract
Although the use of personal medical and health information creates conflicts of interest,it also meets the real needs of preventing and treating public health crises,promoting the development of smart medical enterprises and developing medical research.Because the fair use system itself has the function of reconciling conflicts of interest and promoting the flow of information,and because of the special nature of personal medical and health information,the fair use of personal medical and health information has a cer-tain degree of legitimacy.The fair use system for personal medical and health information should be improved by refining the provisions of the Personal Information Protection Law,strictly interpreting the circum-stances under which personal medical and health information can be used reasonably,and examining the"rea-sonableness"of the use by applying the principle of proportionality.
