摘要
作为蓝碳交易先行区的经验,南海碳汇交易治理的规范对健全碳市场交易制度具有重要意义.实证的数据显示南海碳汇交易规范现状面临以下来问题:低位阶法规范或技术规范被普遍适用、我国规范未在治理中普遍适用、域外规范反而在我国治理中被产生路径依赖.问题形成的关键是,南海碳汇交易治理造成了法规范效力的"三个失灵",即治理模式导致法规范效力位阶"失灵"、治理路径导致法规范效力范围"失灵"、治理主体导致法规范效力认定标准"失灵".解决问题的关键是完善法制,以使法规范符合南海碳汇交易治理.法制方案分为两个层次:一是围绕理念规范、主体规范和责任规范构建规范内容体系.二是围绕多国主体协商的责任规则、国家干预的责任规则和市场运行的责任规则构建具体的责任规范.
Abstract
As the experience of blue carbon sink trading pilot zone,the regulation of carbon sink trading governance in the South China Sea has great significance to improve the carbon trading.From the perspective of empirical analysis of the current situation of carbon sink trading governance norms in the South China Sea,the data show that the norms face the following problems:low-order legal norms or technical norms are generally applied,Chinese norms are not universally applied in governance,and foreign norms are path depen-dent in China's governance.The key to the formation of the problem is that the governance of carbon sink trad-ing in the South China Sea has caused'three failures'of the legal norm effectiveness,that is,the gover-nance model has caused the'failure'of the level about validity of norms,the governance path has caused the'failure'of the space of validity,and the governance subject has caused the'failure'of the legal norm effi-cacy identification standard.The key to solve the problem is to improve the legislative system to make the legal norms conform to carbon sink trading governance in the South China Sea.The legislative scheme is di-vided into two levels:First,build the normative content system around the concept norm,the subject norm and the responsibility norm.Second,specific responsibility norms should be built around the responsibil-ity rules for multinational consultation,state intervention and market operation.
