摘要
《中华人民共和国家庭教育促进法》是国家层面的首部家庭教育专门立法.该法将家庭教育由传统"家事"上升为新时代的重要"国事",旨在推动家庭教育由传统的自发模式转向以法治为引领和驱动的新模式.由于多数家庭教育地方性法规在该法公布前颁布,造成国家立法与地方立法二者之间存在不协调、不一致之处.目前家庭教育地方立法中存在立法配套进程缓慢、法规内容设置不精准、法规条款设置不精细、法规可操作性待加强、立法依据表述不完整、法律体系衔接协调性不足等问题,需要从加快地方立法配套、减少模糊化规定、细化倡导性规定的实现方式、明确家庭教育地方立法的权威依据、增强家庭教育法律规范体系的融贯性等方面加以精细化改进和完善.
Abstract
The Family Education Promotion Law is the first national-level legislation dedicated to family education.The law elevates family education from a traditional"family matter"to an important"national matter"in the new era,aiming to promote the transformation of family education from a traditional spontane-ous model to a new model led and driven by the rule of law.Due to limitations in legislative methods,most lo-cal family education legislation was enacted before the law was announced,resulting in a lack of coordina-tion between the two.Currently,local regulations have problems such as slow progress in supporting local legislation,imprecise content setting of regulations,imprecise setting of regulations provisions,weaken operability of regulations,incomplete expression of legislative basis,and insufficient coordination be-tween legal systems.It is necessary to improve the law by accelerating the process of local legislation,re-ducing vague provisions,supplementing and refining specific rules for national laws,enhancing the imple-mentation of advocacy provisions,clearly stipulating that the Family Education Promotion Law is the only legislative basis,and reviewing rules one by one to avoid conflicts.
