Right Positioning and Capability of Interactive Data in Libraries under the Background of Smart Library Construction
Clarifying the rights and capabilities of interactive data can contribute to the construction practice of smart libraries.At the level of rights enjoyment and acquisition,libraries are able to obtain data rights and compilation works copyright based on the Anti-Unfair Competition Law for initial acquisition of interactive data,and the acquisition of rights is not based on the complete anonymization of personal data.At the level of rights utilization,libraries can obtain the factual control power,exclusive utilization power,exclusive protection power of property rights,and legal disposal power of interactive data.Among them,libraries can legally and de facto control interactive data beyond the negative list explicitly prohibited or restricted by law,and at the same time,through anonymization processing,they can obtain a larger range of legal control freedom;libraries can obtain limited exclusive use rights based on data rights and copyrights;libraries can also be exclusively utilized through physical means,and physical means can obtain certain protection from trade secret clauses and copyright laws.
