The Dilemma and the Way Out of Copyright in Controlled Digital Lending System of Public Library in China
Under the current copyright law rules in China,the behavior of public library providing digital copies of works to bor-rowers is suspected of infringing rightholder's reproduction right and information network communication right.By examining the disputes outside the region,the article finds that under the guidance of the current copyright law concept in China,fair use system could defend the controlled digital lending system,but the better practice is still to include it in the scope of fair use in future revision.The study believes that when practicing the controlled digital lending system,public library should formulate clear operating norms and strictly limit the operating authority of borrowers,trying to make it closer to the traditional offline lending mode,so as to avoid unreasonable influence on copyright owners.
