摘要
数字经济发展加剧个人信息保护风险,诱发政策制度失灵、信息过度分析与数据跨境泄露,敏捷治理所具备的高灵活度与多元主体协作双重优势有助于个人信息保护风险的弥合.文章搭建"信息保护风险的敏捷治理"分析框架,剖析荷兰信息保护与风险防控模式的运作机制.研究发现:敏捷治理消除了个人信息保护工作中的制度建构、数据滥用与监管不足等风险,其中包含复杂的驱动机制,即重构个人信息保护目标与制度,推动政府、市场与公众等多元利益主体协作,以及执行个人信息保护措施,并建构多元监管模式.
Abstract
The rapid development of the digital economy has exacerbated the risks of personal information protection,such as policy and institutional failures,excessive information analysis,and cross-border information leakage.The dual advantages of agile governance,i.e.,high flexibility and multi-entity collaboration,can help to bridge the risks of personal information protection.This paper proposes an analytical framework for"agile governance of information protection risks",and analyzes the operational mechanism of information protection and risk prevention in the Netherlands.The result shows that agile governance could effectively bridge the risks of institutional construction,information abuse,and inadequate regulation in personal information protection;and there are a set of complex driving mechanisms in agile governance,such as restructuring personal information protection goals and systems,promoting collaboration among multiple stakeholders such as the government,the market,and the public,implementing personal information protection measures,and constructing diverse regulatory models.
