New Trends in Copyright Protection under the CPTPP Agreement:Implications for Libraries and Responses
The CPTPP agreement has seen a trend of strengthening copyright protection,such as extending the copyright to temporary reproduction,expanding the neighboring rights,limiting copyright exceptions,extending the term of copyright,and strengthening the protection of technological protection measures(TPMs)and rights management information(RMI),which affects the freedom of libraries in terms of intellectual property rights.By clarifying what can be drawn up from the CPTPP agreement,libraries in China should be alert to the inappropriate extension of copyright protection by the CPTPP.The study proposes that the content of copyright be based on the legislative mode of"inclusion and limitation",focusing on new types of copyright exceptions,insisting on the international exhaustion of distribution rights,opposing the extension of the term of copyright protection,and demanding that libraries be exempted from criminal and some civil liability for circumventing TPMs and infringing RMI.
