Digital Administrative Acts:Concepts,Boundaries and Their Regulations
Digital administration is a new type of government administrative approach since the construction of digital government in China.It refers to administrative acts made by administrative organs relying on in-formation technology means.Digital administrative acts are based on the digital government and possess characteristics such as informatization,automation,cross-regional and cross-departmental collaboration.As digital administration is still in its infancy and differs from traditional administration in both operational means and structures,the issue of its operational boundaries surely deserves in-depth attention,including the technological boundaries brought about by the integration of technological development and administrative acts,the legitimacy boundaries of digital administrative acts,and the ethical boundaries of privacy protection and data usage.Through exploring the operational boundaries of digital administration,new legal issues such as data security and privacy leakage and the digital divide have gradually emerged,hindering the develop-ment of digital administration.To defuse the"risks"of digital administration and seize the"opportunities"of it,it is necessary to conduct legal regulations on digital administration.In this regard,the construction of China's digital government can be achieved by improving digital administrative legislation at the legal level,strengthening the supervision mechanism of digital administration,and building a social co-governance pat-tern with the participation of multiple subjects.Only by improving the potential problems of China's digital administrative acts through the above regulatory methods can the"leading goose effect"of big data and arti-ficial intelligence technologies be better exerted and the construction of China's digital rule-of-law govern-ment be promoted.
