Research on Legal Protection of Sensitive Personal Information
With the continuous development of the Internet and big data,there have been frequent incidents of information processors collecting and handling sensitive personal information in violation of the law.In view of the special nature of sensitive personal information,the damage caused by its misuse or illegal use is far greater than that of general personal information,so it is necessary to adopt more stringent legal safeguards to provide special protection for it.In this regard,China's Personal Information Protection Law has for the first time made relevant provisions for sensitive personal information,but there are still problems such as the lack of a clear legal definition model.Therefore,the logic of defining sensitive personal information can be improved by introducing the"scenario theory",clarifying the premise of handling sensitive personal information,and at the same time,ensuring that the information subject makes a voluntary decision based on the"notification-consent"rule with full knowledge.The above suggestions will not only help to comprehensively strengthen the legal protection of sensitive personal infor-mation,but will also have a positive effect on the improvement of the legal system for the protection of personal in-formation and the construction of an information society based on the rule of law in China.
