涉台营商环境的法理阐释与体系优化

摘要
涉台营商环境是以同等待遇为基础,以促进两岸融合发展为目标的综合性制度环境,具有政务、市场、法治、人文等不同构成要素.自 1979 年以来,涉台营商环境经历了从"招商引资"到"融合发展"的制度逻辑转型过程.在规范构造上,涉台营商环境通过法制供给、行政服务和司法保障三大领域,形成了一个开放性的整体环境.在坚持两岸融合发展的前提下,优化涉台营商环境可以从转变制度供给导向、构建公私合作治理、协调央地权责配置和实施立法评估制度等方面入手.
Abstract
The Taiwan-related business environment is a comprehensive institutional environment based on equal treatment and aimed at promoting cross-Straits integration and development,comprising different components such as government,market,rule of law,and humanities.Since 1979,the Taiwan-related business environment has undergone an institutional transformation from"investment attraction"to"integrated development".In terms of regulatory structure,the Taiwan-related business has formed an open overall environment in the three major areas of legal supply,administrative services,and judicial protection.With the premise of cross-Straits integration and development,the optimization of Taiwan-related business environment can start with transforming the institutional supply orientation,constructing public-private cooperative governance,coordinating central-local authority and responsibility,and implementing a legislative evaluation system.
