浅谈专利创造性判断中的结合启示

摘要
发明专利创造性判断时关于多篇现有技术的结合,涉及"技术手段所起作用相同"时我国《专利审查指南》未给出充分解释,造成审查实践中时常出现创造性判断标准不一致的问题.本文从一个实际案件出发,探讨了结合启示的判断原则,同时梳理了中英两国创造性判断时关于结合启示的相关规定.提出在判断现有技术的结合启示时,应从技术方案的整体性、现有技术的方向性两大原则出发,避免将各种区别特征简单拼凑.
Abstract
When judging the combination of several prior art articles,China patent examination guidelines do not give a full explanation when"technical means play the same role",resulting in inconsistent inventive judgment standards often appear in the examination practice.Starting from a real case,this paper discusses the principle of combination revelation in judgment,and at the same time combs the relevant provisions of combination revelation in inventive judgment in China and UK.This paper proposes that when judging the combination revelation of prior art,we should start from the two principles of the integrity of the technical scheme and the orientation of the prior art,and avoid the simple patchwork of various distinguishing features.
