Exploration of Modifications Over-range in Patent Examining
Aiming at the phenomenon that there is often an inconsistent view of whether the modification is over-range in examination practice,this paper analyzes the related provisions for the modification of the application file in China,Japan and South Korea,finds out the differences and the same,elaborates how to make sure to modify over-range in conjunction with specific case.This paper points out that considering the modification over-range,the both interests of the applicants and the public should be give consideration;currently,China is stricter to the modifications of the application files,it is suggested that newly added content may be considered holistically from a technical contribution point of view.
